Jury Experiences User Agreement and Privacy Policy

The following is a brief summary of the main points of the Jury Experiences User Agreement and Privacy Policy (scroll down to read the Complete Agreement). By accepting this User Agreement you are accepting the terms of the Complete Agreement.

Agreement Summary:

1. You agree to read or post to the Jury Experiences site only if you are at least 18 years of age and are not currently serving on a jury or a member of a jury pool.

2. You agree that by posting or otherwise contributing to the Jury Experiences site you are granting to Jury Experiences and its owners a non-exclusive, irrevocable right to display any original material that you contribute on the Jury Experiences site.

3. You agree that the owners and operators of the Jury Experiences site may edit or delete posts, and may suspend or revoke users' posting privileges, as they deem necessary to maintain the propriety and integrity of the site.

4. You agree not to interpret anything on the Jury Experiences site as legal advice, not to hold the owners or operators of the site responsible for any inaccurate information posted on the site, and not to sue the owners or operators of the site.

5. You agree not to make fraudulent posts on the Jury Experiences site; not to post illegal content; not to post obscene, threatening, off-topic or otherwise abusive content; and not to spam, harass or otherwise abuse other contributors to the site.



Complete Agreement:

Jury Experiences is intended as an open forum to provide information, and a venue for discussion, about what really happens in jury rooms, court rooms and in the jury selection process, in various courts and jurisdictions and especially from the juror's perspective. The site is premised on the belief that the jury system is a bulwark of our civil liberties and that citizens may benefit from open discussion about how that system functions in the real world. The site's intended audience includes past and prospective jurors, attorneys and other legal professionals and anyone else who takes an interest in government and legal systems.

This Agreement describes the terms and conditions applicable to your use of any site under the Internet domain and sub-domains of www.juryexperiences.org or juryexperiences.org ("Jury Experiences" or "the site") or their content. If you object to the terms and conditions of this Agreement, please refrain from using the site, because this Agreement is a waiver of any and all rights to sue for damages incurred as a result of your use of the site. If you accept the terms and conditions of this Agreement then, by reading, posting to, linking to, printing out, quoting or in any other way making use of the site or its content, you agree to the following terms and conditions:

Binding Effect. You are deemed to have read and accepted all of the terms and conditions contained in this Agreement, before you read, register to post or post content on the site.

Ownership and Copyright. The Jury Experiences site and its content are owned by Jury Experiences. All content, original artwork and layouts, original graphic design elements, data and original images on the site are copyrighted by Jury Experiences. By posting or otherwise contributing to the site you are granting to Jury Experiences and its owners a non-exclusive, perpetual, irrevocable, worldwide, royalty-free right to edit, use, publish, display and transmit any original material that you contribute. The use of user-contributed content by Jury Experiences or its owner may not be restrained or prohibited unless the act of displaying such content has been shown to violate laws governing defamation, governmental security or libel. Jury Experiences reserves the right to remove any content at any time without such removal being deemed a waiver of its rights. JuryExperiences.org, JuryExperiences.com, JuryExperiences.net, "Jury Experiences", "Exploring the Realities of the Jury System" and "What Really Happens on Juries" are all trademarks belonging to Jury Experiences.

Changes to this Agreement. This Agreement may be modified by the site's owner at any time and without notice. The modified Agreement will be posted on the site, takes effect immediately when it is posted and supercedes all previous versions. You agree to familiarize yourself with and be bound by the terms of the latest version of this Agreement, or to stop reading, posting to, linking to, printing out, quoting or in any other way making use of the site and its content.

Waiver and Release. Jury Experiences does not offer legal or other advice and nothing on the site should be construed as advice of any kind. The site is an open forum to which anyone may contribute and whose contents consist mainly of unvalidated assertions and opinions. Do not rely on it for facts or advice. If you need legal advice you should consult your own attorney. If you need information about the rules or procedures of jury service in a particular court or jurisdiction you should consult the appropriate officials of that court or jurisdiction. By reading, posting to, linking to, printing out, quoting or in any other way making use of the site or its content you waive and release any and all claims, demands, causes of action or rights to sue for damages against Jury Experiences, its current or future owner or owners and their shareholders, partners and associates, its administrators, moderators and webmasters ("administrators"), advertisers and marketing partners, its Internet hosting company and other service providers (including each party's officers, directors, subsidiaries, joint ventures and employees) for the actions of the site's owners, administrators, advertisers, business or marketing partners, or users; for any injuries, misfortunes, monetary or other costs, breaches of privacy, legal judgments, damages, injuries or civil or criminal liabilities whatsoever that you incur or to which you are subjected, either as a consequence of your use of the site or as a consequence of your involvement in the legal system (for example, as a juror or a civil or criminal defendant) or for any other reason whatsoever.

Outages. Jury Experiences does not warrant or guarantee uninterrupted access to the site. Indeed the site may be taken offline, briefly for maintenance and/or backup and, in cases beyond our control, for periods of time whose duration we are not able to estimate.

User Conduct. Jury Experiences, its owner and administrators do not intend to encourage and do not condone jury nullification, avoidance of jury duty, juror misconduct, contempt of court or any unlawful behavior. YOU AGREE NOT TO READ OR POST ON THE SITE IF YOU ARE CURRENTLY SERVING AS A JUROR, JUROR ALTERNATE OR MEMBER OF A JURY POOL OR ARE OTHERWISE PERFORMING OFFICIAL JURY SERVICE.

You agree not to disclose grand-jury proceedings except to the extent that you are legally permitted to do so as a grand-jury witness.

You agree not to maintain more than one user identity at a time, and not to change user identities in a way that is intended or likely, in the opinion of the site's administrators, to mislead or confuse other users.

While the administrators will attempt to remove or edit objectionable material, it is impossible for them to review every message. You agree that each post on the site expresses the views and opinions of its author and not those of Jury Experiences or its administrators, owner or advertisers (except for posts by such parties) or the site's Internet hosting company. Jury Experiences is a forum that is intended to facilitate the exchange of ideas and information submitted by contributors; it is not a publisher. You agree that neither Jury Experiences nor its administrators, owner or advertisers are responsible for the authenticity, accuracy, truthfulness or consequences of anything that anyone posts on the site (except for posts by such parties).

You agree that Jury Experiences or its administrators may take whatever action they deem necessary to maintain the propriety and integrity of the site, even if such action includes suspension or permanent revocation of your privileges here. You agree that the site's administrators have the right to remove, edit, move or close any post, topic or discussion at any time, and to delete user accounts which they deem to violate the letter or spirit of this Agreement. YOU DO NOT HAVE THE LEGAL RIGHT TO PARTICIPATE ON THE SITE. YOU HAVE A PRIVILEGE AND A LICENSE, WHICH MAY BE REVOKED AT ANY TIME.

You agree not to post material that is fraudulent, abusive, obscene, vulgar, slanderous, hateful, threatening, falsely attributed, intended to influence the outcome of a specific trial, or that may violate any law of the United States or of any of its constituent states.

No Posting During Jury Duty. You agree not to post on the site about your friends', relatives' or other associates' current or pending jury service, or any trials in which you are currently involved or may become involved in an official capacity. WAIT UNTIL THE TRIAL IS OVER BEFORE YOU POST. IF YOU ARE A JUROR, WAIT UNTIL BOTH THE TRIAL AND YOUR JURY SERVICE ARE OVER BEFORE YOU POST.

Copyrighted or Trademarked Material. You agree not to post any content that is copyrighted or trademarked, unless you hold the copyright or trademark on that content or have the written permission of the author or owner of the copyright or trademark. It is acceptable to provide a link to copyrighted material, to post brief excerpts or to paraphrase other works, though we strongly encourage you to cite the original source whenever possible. You may not post the full text of news stories, articles, etc. or post copyrighted images.

User Eligibility. You agree not to post on the site unless you are at least 18 years of age. If you are less than 18 years of age you may only read Jury Experiences while you are under the direct supervision of your parent or legal guardian.

Privacy. Jury Experiences welcomes anonymous and pseudonymous posts in the spirit of open discussion, and will attempt to safeguard registered users' personal information. However, by registering as a user of or otherwise contributing to the site you acknowledge that neither Jury Experiences, its owner, administrators or Internet hosting company can warrant or guarantee your anonymity.

Jury Experiences may share aggregated information about its readers and/or contributors, such as survey results and user demographics, with third parties for marketing and/or other business purposes. However, Jury Experiences will not share personally identifiable information about users with third parties without the express written authorization of the affected users unless the site or its owner is compelled to do so by legal process.

Jury Experiences runs on forum software that may use cookies to store information on your computer. The purpose of these cookies is to personalize your viewing experience and/or facilitate the serving of advertisements. These cookies do not contain any of the personal information (other than your display settings and preferences) that you enter when you register as a user of the site or when you submit personal information as part of a user profile. Third-party advertisements displayed on the site may use their own cookies over which neither the site nor its administrators or owner have control. Clicking on such third-party advertisements may transport the user to Web sites away from the Internet domain and sub-domains of www.juryexperiences.org or juryexperiences.org and over which neither Jury Experiences nor its owner, administrators or Internet hosting company have control.

You agree that any information that you have entered or posted on the site will be stored in a database or by other electronic means, and that you will not hold Jury Experiences, its owner, administrators, advertisers, the site's Internet hosting company or the company that produced the forum software or other service providers responsible for any hacking attempt that may lead to the contents of the database or the site being compromised.

Links. Jury Experiences may publish links, or a list of links (similar to a "blogroll") to Internet sites which the administrators think may be of interest to Jury Experiences readers. Clicking on such links may transport the user to Web sites away from the Internet domain and sub-domains of www.juryexperiences.org or juryexperiences.org. Such sites are not under the control of, and do not necessarily reflect the views or opinions of, Jury Experiences, its owner, administrators or Internet hosting company.

Applicable Law. This Agreement is governed by the laws of the United States and the state of Florida.

Severability. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
